Preventing conflict of interest and corruption in public procurement
Pursuant to Article 5c Section (1) of the Public Procurement Act (OG 110/07 and 125/08),
a contracting authority shall not enter into public procurement contracts with an economic operator if the head of the body or member of the management or the supervisory body of that contracting authority, at the same time:   

  • Performs management-related activities in that economic operator or
  • Holds a business share, stock or other rights entitling them to participate in management, that is, capital of the economic operator by more than 20%.

Pursuant to Article 5c Section (3) of the Public Procurement Act (OG 110/07 and 125/08), the Agency declares that there are not any economic operators to which ASHE is not allowed to award public procurement contracts in terms of Article 5c Section (1) of the Act.
